The trader is wrong you still have rights when you buy from a business trader on an auction site. Read the Factsheet - When buying in an online auction
If you have explained your rights to a trader and are still unable to resolve the situation, then contact the site owner. The site itself may offer extra protection through its terms and conditions or payment protection scheme. They may offer a mediation/dispute resolution service.
If you are still unable to resolve the issue, than you can seek compensation through the courts. If it is under £5,000 you can use the simpler Small Claims Court. More information about going to court can be found on the Citizens Advice Bureau website.
If the claim is against someone who is difficult to trace, or has no money, you may have to write the loss off to experience.
